Defendants sentenced on Friday

The following additional defendants were sentenced on Friday by President Judge Maureen Skerda.

¯ Rebecca Lynn Abbott, Falconer, NY, to a six month intermediate punishment sentence, with five days to be served as incarceration in the Warren County Jail, and the duration to be served on probation on a count of DUI: General impairment/incapable of safe driving – second offense. She was ordered to pay $400 in fees, a $300 fine, to complete the alcohol highway safety school and victim impact panel programs and complete 30 hours of community service. Her driver’s license was suspended for 12 months and she is work release and early re-entry eligible. She was fined a total of $545 and an additional 12 month license suspension on a count of illegally operating a vehicle with ignition interlock. She was fined a total of $70 each on counts of driving on right side of roadway and careless driving.

¯ Cody J. Anderson, Frewsburg, NY, to a six month intermediate punishment sentence, with five days to be served as incarceration in the Warren County Jail, and the duration to be served on probation on a count of DUI: Highest rate of alcohol – second offense. He was fined a total of $800, to complete the alcohol highway safety school and victim impact panel programs, to complete 30 hours of community service and to continue outpatient drug and alcohol treatment. His driver’s license was suspended for 12 months  and he is work release eligible. On counts of driving at safe speed and careless driving he was fined a total of $70 and $55 for a restraint systems violation.

¯ Joshua J. Dyke, Jamestown, NY, to a six month intermediate punishment sentence, with 41 days to be served as incarceration in the Warren County Jail and the rest on probation, on a count of DUI: General impairment/incapable of safe driving – second offense. He was fined a total of $925, to complete the alcohol highway safety school and victim impact panel programs and 30 hours of community service. His driver’s license was suspended for 12 months and he was given credit for 41 days time served, making him eligible for immediate parole. He was fined a total of $345 and given three month license and registration suspensions on a count of required financial responsibility. He was fined $70 on a count of turning movements and required signals.

¯ David A. Gonzalez, Corry, to 12 to 36 months in a state correctional institution on a count of theft by unlawful taking. He was fined a total of $1,175, ordered to have no contact with the victim or trespass on the victim’s property, to submit a DNA sample and will receive priority for drug and alcohol programs in the state system. He was given 64 days credit for time served and is boot camp eligible but not recidivism risk reduction incentive eligible.

¯ Jacquelyn Hayes, Jamestown, to two years probation on a count of theft by deception – false impression. She was ordered to pay $150 in restitution, $500 in fines and fees, complete 30 hours of community service and follow through with drug and alcohol treatment.

¯ Jason D. Hoibraten, Waterford, to 16-32 months incarceration in a state correctional facility on a count of DUI: High rate of alcohol – second offense. He was fined a total of $2,000, ordered to complete the alcohol highway safety school and victim impact panel programs and complete 100 hours of community service. His driver’s license was suspended for 18 months and he was given credit for 17 days time served. He was given priority for drug and alcohol programs in the state system and is boot camp and recidivism risk reduction incentive eligible. He was given a concurrent 6-12 months of incarceration on a count of endangering the welfare of a child and fined $70 each on charges of obedience to authorized person directing traffic – appropriately attired and careless driving.

¯ Justin K. Lancaster, Irvine, to three years probation on a count of receiving stolen property. He was fined a total of $1,325, ordered to pay $1,600 in restitution and not to have contact with the victim or trespass on the victim’s property. He was ordered to participate in a recovery program, obtain a sponsor and attend three weekly self-help meetings.

¯ Krystina E. Papaserge, Jamestown, NY, to $134.83 in restitution and $625 in fines and fees on a count of theft by deception.

¯ Stephanie L. Rapp, North Warren, to two years probation, $700 in restitution, $900 in fines and fees, participation in a mental health regimen and 150 hours of community service on a count of theft by deception.

¯ Jose A. Rodriguez, Youngsville, to seven to 14 months incarceration in the Warren County Jail on a count of simple assault. He was fined a total of $775, ordered to have no contact with the victim, to complete 50 hours of community service, to participate in a healthy relationships evaluation and was given credit for 160 days time served. He is work release and early re-entry eligible.

¯ Cody A. Streit, Warren, to three years probation, $40 in restitution to the Warren County Drug Task Force, $2,425 in fines and fees, submission of a DNA sample, participation in a drug and alcohol evaluation and treatment and a six month driver’s license suspension on a count of possession with intent to deliver.

¯ Terry Wagner, Warren, to eight months to 20 months incarceration in the Warren County Jail on a count of indecent assault – forcible compulsion. He was fined a total of $1,575, ordered to submit a DNA sample to participate in the healthy relationships, COG and sex offender counseling programs and ordered to complete 60 hours of community service. He was given credit for 29 days time served and is work release and early re-entry eligible. He is now a Tier II Megan’s Law sexual offender, requiring a 25 year registration period.

¯ Jimmie L. Williams, Jamestown, NY, to three years probation, $1,900 in restitution, $2,300 in fines and fees to have no contact with his victim or trespass on the victim’s property and to complete 200 hours of community service on a count of conspiracy (theft by unlawful taking). He was also ordered to continue with his drug and alcohol treatment.

A bench warrant was issued for the arrest of Emily M. Lundmark, Warren, for failure to appear for sentence court. She was to be sentenced on charges including possession of drug paraphernalia, DUI: Controlled substance – Schedule I – first offense, careless driving and rear lighting.
