Sex charge draws prison term

A Warren man charged with aggravated indecent assault of a mentally handicapped woman will serve time at a state correctional facility as a result of sentencing on Thursday at the Warren County Courthouse.

The Commonwealth withdrew its plea for a sexually violent predator hearing for Steven J. Miles of Warren and proceeded with sentencing with Common Pleas Judge Gregory J. Hammond presiding.

Miles was advised of his rights to a post-sentencing appeal and conditions following his felony conviction on the charges of aggravated indecent assault without consent and aggravated indecent assault - forcible compulsion. He was also convicted on misdemeanors of indecent assault without consent of other and indecent assault - forcible compulsion.

The court then discussed the results of an assessment in which Miles was found to not be a sexually violent predator though he was admittedly described as a pervert by roommates.

Miles' victim was present in court and addressed Judge Hammond saying: "I feel scared. What he did to me - he took advantage of me and my family. What he did... I don't know what I did to deserve this."

Miles had no statement to provide before the sentence was handed out.

According to Judge Hammond, the long-lasting effects of Miles' actions, his failure to take responsbility for his actions, and the disruption he caused in the victim's family life was enough to sentence him to an aggregate sentence of a minimum of 28 months in a state correctional facility up to a maximum of 56 months.

The sentence was as follows:

For the felony charges: aggravated indecent assault - forcible compulsion, a minimum of 28 months to a maximum of 56 months. For aggravated indecent assault without consent, a minimum of 28 months to a maximum of 56 months concurrent with the initial sentence.

For the misdemeanor charges: indecent assault without consent of other, a minimum of two months to a maximum of four months. For indecent assault - forcible compulsion, a minimum of two months to a maximum of four months concurrent with the initial sentence.

In addition to time served, he will be required to pay fines, costs, and probation fees totaling $1500.

Miles will also be required to register in accordance with Megan's Law which requires lifetime registration and classifies him as a tier 3 offender. He was taken into custody and his sentence began immediately.
