22 defendants sentenced in court

Twenty-two individuals were sentenced by Judge Gregory Hammond on Friday afternoon at the Warren County Courthouse. They include:

Tracy Antill, 725 W. Spring St., Titusville, to two years probation on a count of theft by unlawful taking, a first-degree misdemeanor. Antill was also ordered to pay the costs of prosecution, a $300 fine, $250 in fees and $8,312 in restitution. She was ordered to have no contact with the victim, not to enter the victim's property and ordered to complete 50 hours of community service.

Mitchell West, 30006 Route 6, Youngsville to six months probation on a count of DUI: General impairment - incapable of safe driving. He was ordered to pay the costs of prosecution, a $300 fine, $400 in fees, participate in the Alcohol Highway Safety Program and the Warren County Victim Impact Panel. West was ordered to follow treatment recommendations and participate in 15 hours of community service. On a separate count of driving on roadways laned for traffic, West was ordered to pay a $25 fine and a $30 surcharge.

Daniel M. Bevevino, 605 Stanton Hill Rd., Russell, to a minimum of one year to a maximum of three years in a state correctional institution on a felony count of possession with intent to deliver. He was granted credit for time served. He was ordered to pay a $2,500 fine, $700 in fees and the cost of prosecution. He will undergo a DNA test and his driving privileges were suspended for six months. On a separate count of harassment, Bevevino was ordered to pay the costs of prosecution, $400 in fees and ordered to have no contact with his victims.

Aaron Jay Brew, 24 Walnut St., to 46 days to one year in the Warren County Jail with credit for time served on a charge of sell/furnish liquor, etc. to minor. Brew was also ordered to participate in a drug and alcohol evaluation and pay the costs of prosecution, a $1,000 fine and $350 in fees. He was sentenced to complete 50 hours of community service, undergo a drug and alcohol evaluation and follow all recommendations and ordered to have no contact with his victim. On a separate count of defiant trespass, Brew was sentenced to one year of probation, a $500 fine and 50 hours of community service.

Andrew S. Byler, 1370 Rounds Hill Rd., Sugar Grove, to one year probation on a count of theft by unlawful taking. He was ordered to pay the costs of prosecution, a $500 fine, $250 in fees, and $1,000 in restitution. He was ordered to have no contact with his victim. On a separate count of defiant trespass, Byler was ordered to pay a $300 fine.

Beverly Ann Cox, 422 Giles Rd., Rice, Va., to two years of probation on a count of theft by unlawful taking. The probation can be transferred to Virginia. She was ordered to pay the costs of prosecution, a $500 fine and $250 in fees. She was ordered to have no contact with her victim and not to enter the victim's property and was also sentenced to 50 hours of community service.

Darryl Daniel Dase, 318 Giles Rd., Rice, Va., to two years of probation on a count of theft by unlawful taking. He was ordered to pay the costs of prosecution, a $500 fine and $250 in fees. He was ordered to have no contact with the victim and not to enter the victim's property. He was sentenced to complete 50 hours of community service. On a count of recklessly endangering another person, Dase was sentenced to an additional year of probation to be served consecutively, a $500 fine as well as 50 additional hours of community service.

Brad L. Dipenti, 56 S. Pickering St., Apt. B., Brookville, to 72 hours to six months in the Warren County Jail on a count of DUI: highest rate of alcohol (BAC +.16). He was ordered to pay the costs of prosecution, a $1,000 fine and $750 in fees. He was ordered to participate in the Alcohol Highway Safety Program and the Warren County Victim Impact Panel, 30 hours of community service and complete all treatment recommendations. His driving privileges were suspended for one year. On a count of accident involving damage to unattended vehicle/property, Dipenti was ordered to pay a $300 fine and a $40 surcharge.

Debra Lynn Farnham, 14 Carriage St., Youngsville, to the costs of prosecution, a $300 fine, $250 in fees and $1,514 in restitution on a count of cruelty to animals. She was also ordered to have no pets in the home.

Michael B. Salsgiver, 240 Main St., Tidioute, to two years probation on a count of simple assault. He was ordered to pay the costs of prosecution, a $500 fine and $250 in fees. He was ordered to undergo a drug and alcohol evaluation, have no contact with his victim and complete 50 hours of community service.

Michael Todd Frazier, 18 Hinkle St., to two years probation on a felony count of possession with intent to deliver. He was ordered to pay the costs of prosecution, $700 in fees and a $500 fine. He was sentenced to complete all treatment recommendations, undergo a DNA test and complete 50 hours of community service. His driving privileges were revoked for one year.

Kimberly Harrison, 333 Buchanan St., to nine months to 2 years in a state correctional institution on a count of obstructing administration of law or other governmental. She was ordered to pay the costs of prosecution, a $500 fine and $350 in fees. She is RRRI and boot camp eligible.

Barry David Fox, Hull Hill Road, Youngsville, to five days to 6 months in the Warren County Jail on a count of DUI: general impairment - incapable of safe driving. He was ordered to pay the costs of prosecution, a $500 fine and $350 in fines. His driving privileges were revoked for one year, sentenced to complete 30 hours of community service and ordered to participate in the Alcohol Highway Safety Program and the Warren County Victim Impact Panel. On a count of possession of a small amount of marijuana, Fox was ordered to pay a $500 fine and $100 in fees. His driving privileges were suspected for an additional six months.

Clayton Hesch, 216 Jefferson St., to one year of probation on a count of disorderly conduct. He was ordered to pay the costs of prosecution, a $300 fine and $350 in fees. He is to undergo a drug and alcohol evaluation and a healthy relationships evaluation and complete all recommendations.

Matthew S. Irvine, 456 E. Main St., Youngsville, to one month to one year in the Warren County Jail on a count of possession of drug paraphernalia. His sentence was in the aggravated range due to an ARD revocation. He is work release eligible. He was ordered to pay the costs of prosecution, a $300 fine and $350 in fees as well as to undergo a drug and alcohol evaluation and complete all recommendations. He was ordered to complete 25 hours of community service.

David Woodrow Jenkins III, 14 Fullerton Rd., Clarendon, to 15 months to 4 years in a state correctional institution on a felony count of possession with intent to deliver. He is boot camp eligible but not RRRI eligible. He was ordered to pay a $2,500 fine, $700 in fees and the costs of prosecution. He was ordered to undergo a DNA test and his driving privileges were suspended for one year.

James Robert Lucas, 17 Plum St., to one year probation on a count of harassment. He was ordered to pay the costs of prosecution, a $300 fine and $350 in fees. He is to complete 25 hours of community service, undergo a drug and alcohol evaluation and complete all recommendations and was ordered to have no contact with the victim. On an additional count of harassment, Lucas was sentenced to an additional year of probation, ordered to pay the costs of prosecution, a $400 fine, $350 in fees, have no contact with his victim and complete an additional 25 hours of community service.

Jay R. Peck, 99876 Gerry-Levant Rd., Falconer, N.Y., to 153 days to two years less one day in the Warren County Jail with credit for time served on a count of terroristic threats. He was ordered to undergo a drug and alcohol and mental health evaluation. He was sentenced to pay the costs of prosecution, a $1,000 fine and $250 in fees. On a count of public drunkenness, Peck was ordered to pay a $300 fine, the costs of prosecution and $100 in fees. For a count of resisting arrest or other law enforcement, Peck was sentenced to two years of probation that is transferable to New York State, a $500 fine and to complete 50 hours of community service.

Tara Lynn Schulz, 183 Colfax St., Jamestown, N.Y., to two years of probation that can be transferred to New York State on a felony count of retail theft. She was ordered to pay the costs of prosecution, a $500 fine, $500 in fees and $358.22 in restitution. She was ordered to undergo a DNA test, complete 50 hours of community service and ordered not to enter Walmart property.

Heather Nicole Smith, 409 Laurel St. Apt. 3, to one year of probation on a count of defiant trespass. She was ordered to pay the costs of prosecution, a $300 fine, $250 in fees as well as complete 25 hours of community service. She was ordered not to enter Walmart property.

Renee L. Steele, 14 Homestead Dr., Youngsville, to 121 days to one year in the Warren County Jail with credit for time served on a count of disorderly conduct. She is eligible for immediate parole. She was ordered to pay the costs of prosecution, $350 in fees and a $300 fine. She was ordered to undergo a drug and alcohol evaluation and complete all recommendations, sentenced to complete 25 hours of community service and ordered to have no contact with her victim. On a count of harassment, she was sentenced to a $300 fine. On a count of possession of drug paraphernalia, she was sentenced to one year probation and ordered to pay the costs of prosecution, a $300 fine and a $100 fee.

Ashley John Thornton, 515 Water St., Apt. 3N, to one to three years in a state correctional institution with credit for time served on a count of felony retail theft. He is boot camp and RRRI eligible. He was ordered to pay the costs of prosecution, a $500 fine, $250 in fees and $9.99 in restitution. He was sentenced to undergo DNA testing and not to enter BiLo property.
