How Offenses Are Categorized

Act 111 of 2011, signed on Dec. 20 of last year, sets forth a number of changes as to what offenses require registration as a sexual offender.

The changes will include the addition of 25 offenses requiring registration as a sexual offender which were not listed under the old law.

Offenses which will now require registration include violations of laws relating to:

Listed as Tier I under Act 111:

Unlawful restraint of a child by a person not a parent or guardian

False imprisonment of a child by a person not a parent

Interference with custody of children

Corruption of minors when related to sexual offenses

Invasion of privacy

Video voyeurism

Material involving the sexual exploitation of minors

Material constituting or containing child pornography

Misleading domain names on the internet related to the sexual exploitation of minors

Misleading words or digital images on the internet related to the sexual exploitation of minors

Coercion or enticement related to transportation for the sexual exploitation of minors

Transportation of minors for sexual exploitation

Filing factual statements about alien individuals related to transportation for the sexual exploitation of minors

Use of interstate facilities to transmit information about a minor related to sexual exploitation

Listed as Tier II Under Act 111:

Statutory sexual assault (age difference less than 11 years)

Sex trafficking of children by force, fraud or coercion

Sexual abuse of a minor or ward

Abusive sexual contact

Sexual exploitation of children

Selling or buying of children for sexual exploitation

Production of sexually explicit depictions of a minor for importation into the United States

Transportation for sexual exploitation

Listed as Tier III under Act 111:

Involuntary deviate sexual intercourse

Aggravated sexual abuse

Sexual abuse

Offenses which already required registration include violations of laws relating to:

Listed as Tier I under Act 111:

Luring a child into a motor vehicle or structure

Institutional sexual assault

Indecent assault

Listed as Tier II under Act 111:

Prostitution and related offenses related to promotion of prostitution of a minor

Obscene and other sexual materials and performances related to sexual exploitation of minors

Sexual abuse of children

Unlawful contact with a minor

Sexual exploitation of children

Listed as Tier III under Act 111:

Kidnapping of a minor

Rape

Statutory sexual assault (age difference more than 11 years)

Sexual assault

Aggravated indecent assault
