A man accused of having sexual relations with a man who was unable to give consent was held for further court action at a preliminary hearing Wednesday before District Justice Cynthia Lindemuth.

Richard Allen Goodman III, 101 E. Main St., Apt. 4, Youngsville, is charged with four counts each of rape and involuntary deviate sexual intercourse.

According to court documents, Goodman and the 19-year-old victim met on a Transit Authority of Warren County bus in May.

Soon thereafter, the men entered into a physical relationship.

According to the documents, the two engaged in anal sex four times, with the last being on June 19. On June 19, at Goodman's apartment, the victim drank three beers and fell asleep on Goodman's bed. He awoke, according to the

document, to find Goodman having anal intercourse with him. Goodman did not stop when the victim told him to, the document said.

The victim's mother contacted Youngsville Borough Police on June 19 to report a sexual assault.

Goodman told police the victim consented each time, according to the document, but police informed Goodman that it is possible the victim could not legally give consent due to his mental disability.

The result of the preliminary hearing was not a finding of guilt or innocence. Lindemuth ruled only that there was sufficient evidence to move to the next step of the court process.
