District Judge Gregory Hammond handed down sentences to 27 defendants Friday during Warren County court proceedings.
Stephen P. Bashaw, 108 Oak St., Apt. 203, to serve between 141 days and one year in the Warren County Jail, with credit given for 141 days served, on counts of disorderly conduct and retail theft. Bashaw was also sentenced to perform 25 hours of community service and to continue mental health treatment. Bashaw was ordered to pay $753.72 in fines, cost and restitution and ordered not to enter the property of Thorne's Bilo.
Michael B. Baxter, 447 N. Main St., Russell, to one year of probation for a count of disorderly conduct. Baxter was also ordered to undergo a drug and alcohol evaluation, perform 50 hours of community service and pay $550 in fines and costs. Baxter was also ordered not to enter the property of the Golden Living facility.
Timothy S. Berlin, 14 Third St., Tidioute, to two years of probation on a count of conspiracy to commit simple assault. Berlin was also sentenced to perform 50 hours of community service, undergo a drug and alcohol evaluation and pay $750 in fines and costs.
Chad Alan Carlson, 4860 Miller Hill Rd., Sugar Grove, to serve between eight months and two years less one day in the Warren County Jail on a count of statutory sexual assault. Carlson was also sentenced to two years probation following his incarceration, to submit a DNA sample and to take part in a sexual offenders program. Carlson was sentenced to two additional years of probation for a count of interference with the custody of children, to be served consecutively. Carlson was also ordered to pay $2,000 in fines and costs.
Michele Leigh Covell, 1653 Brown Run Rd., Clarendon, to one year of probation for a count of disorderly conduct. Covell was also ordered to undergo a drug and alcohol evaluation, undergo a mental health evaluation, perform 25 hours of community service and pay $550 in fines and costs.
Timothy Allen Cressley, 1345 Sample Flatts Rd., Corry, to between 72 hours and six months incarceration in the Warren County Jail on a count of DUI: Highest rate of alcohol (BAC .16+). Cressley was also ordered to serve a 12 month suspension of driving privileges, perform 15 hours of community service and attend the alcohol highway safety school and victim impact panel programs and was ordered to serve an additional 12 month suspension of driving privileges for a count of driving while under suspension. Cressley was ordered to pay an additional fine for a count of careless driving. Cressley was ordered to pay a total of $1,180 in fines and costs.
Tyler James Emery, 1408 Pennsylvania Ave. East, to one year of probation for a count of possession of a controlled substance. Emery was also ordered to serve a six month suspension of driving privileges, undergo a drug and alcohol evaluation, perform 50 hours of community service and pay $950 in fines and costs.
David Michael Fiorella, 874 Big Tree Rd., Jamestown, NY, to two years of probation for a count of possession with intent to deliver a controlled substance. Fiorella was also ordered to undergo a drug and alcohol evaluation, submit a DNA sample, serve a six month suspension of his driving privileges in the Commonwealth of Pennsylvania, perform 50 hours of community service and pay $1,490 in fines, costs and restitution.
Jeffrey Sheldon Gray, 843 Smutz Rd., to between 30 days and six months incarceration in the Warren County Jail, with credit for time served, for a count of DUI: General impairment incapable of safe driving with an accident. Gray was also ordered to attend the alcohol highway safety school and victim impact panel programs, continue drug and alcohol treatment, perform 30 hours of community service, serve a 12 month suspension of driving privileges and pay $1,600 in fines and costs.
Christopher J. Guiffre, 36 Warren Blvd., to six months of probation for a count of DUI: General impairment incapable of safe driving. Guiffre was also ordered to attend the alcohol highway safety school and victim impact panel programs, complete current drug and alcohol treatment and perform 15 hours of community service. Guiffre was ordered to pay an additional fine for a related charge of careless driving and was ordered to pay a total of $855 in fines and costs.
Robert Vincent Gurry, 254 Lynnway, Apt. 208, Lynn, MA, to two years of probation for a count of possession with intent to deliver a controlled substance. Gurry was also ordered to submit a DNA sample, serve a six month suspension of driving privileges in the Commonwealth of Pennsylvania and undergo a drug and alcohol evaluation. On a related charge of criminal use of a communication facility, Gurry was sentenced to an additional two years of probation. He was ordered to pay $2,700 in total fines and costs.
Vicky M. Halle, 99 Kamp St., to between 48 hours and six months incarceration in the Warren County Jail on a count of DUI: High rate of alcohol (BAC .10 - .16). Halle was also ordered to attend the alcohol highway safety school and victim impact panel programs, undergo a drug and alcohol treatment, undergo anger management treatment, perform 15 hours of community service and serve a 12 month suspension of driving privileges. Halle was ordered to pay fines for related counts of driver required to be licensed and careless driving. She was ordered to pay $1,285 in total fines and costs.
Amy Nicole Hornstrom, 502 Lexington Ave., to one year of probation for a count of retail theft. Hornstrom was also ordered to undergo a mental health evaluation and treatment, perform 25 hours of community service and pay $729 in fines, costs and restitution. Hornstrom was ordered not to enter Walmart property.
Teresa M. Hummel, Warren State Hospital, to serve 36 to 72 months incarceration in a state correctional facility with credit for time served for a count of felony aggravated assault. Hummell was also ordered to pay $1,250 in fines and costs. She is to have no contact with her victim. Hammond noted Hummell has at least four prior assault charges.
Aaron Arthur Johnson Jr., 117 N. South St., Apt. 2, was sentenced to two years of probation for a count of simple assault. Johnson was also ordered to undergo anger management treatment and to pay $850 in fines and costs. Johnson is to have no contact with his victim or witnesses to the assault.
Gary Lee O'Donnell, 6990 Matthews Run Rd., Sugar Grove, to 5 years in the intermediate punishment program; the first 90 days to be served in the Warren County Jail, the next 30 days to be served in intensive inpatient rehabilitation, the following 90 days to be served in inpatient rehabilitation and the following 155 days to be served on house arrest, followed by four years of probation; for a count of DUI: Highest rate of alcohol (BAC .16+). O'Donnell was also ordered to undergo six months of drug and alcohol counseling, attend 4 Alcoholics Anonymous meetings per week, attend the alcohol highway safety school and victim impact panel programs, perform 30 hours of community service and serve an 18 month suspension of driving privileges. O'Donnell was ordered to pay a fine for a related charge of careless driving. He was ordered to pay $2,505 in fines and costs.
Shamus Lee O'Donnell, 11190 Jackson Run Rd., Sugar Grove, to between six months and two years less one day in the Warren County Jail on a count of indecent assault. O'Donnell was also ordered to submit a DNA sample, undergo sexual offender counseling and undergo a drug and alcohol evaluation. On a related count of selling/furnishing liquor to minors, O'Donnell was sentenced to one year of probation. He was ordered to pay $2,000 in total fines and costs. O'Donnell was ordered to have no contact with the victim and no contact with minors.
Eric R. Pierce, 43377 Chase Rd., Spartansburg, to between 73 hours and six months incarceration in the Warren County Jail for a count of DUI: Highest rate of alcohol (BAC .16+). Pierce was also ordered to attend the alcohol highway safety school and victim impact panel programs, undergo a drug and alcohol evaluation, perform 15 hours of community service and serve a one year suspension of driving privileges. On a related charge of unauthorized use of auto and other vehicles, Pierce was sentenced to serve between five and 18 months incarceration in the Warren County Jail to be served consecutively with credit for time served. Pierce was ordered to pay a fine for a related charge of driving while under suspension. He was ordered to pay a total of $2,630 in fines, cost and restitution. Pierce was ordered to have no contact with his victim.
Nicholas Lysle Pitner, 10170 Jackson Run Rd., Sugar Grove, to two years of probation for a count of possession with intent to deliver. Pitner was also ordered to undergo drug and alcohol treatment, submit a DNA sample, perform eight hours of community service, serve a one year suspension of driving privileges and pay $2,200 in fines and costs.
Burt Reginald Renwick, 293 Dalrymple St., Pittsfield, to five years in the intermediate punishment program, the first 30 days to be served in the Warren County Jail and the following 60 days on house arrest, the remainder of the five years to be served on probation, on a count of DUI: Highest rate of alcohol (BAC .16+) . Renwick was also ordered to attend the alcohol highway safety school and victim impact panel programs, perform 30 hours of community service and to serve an 18 month suspension of driving privileges. A related count of careless driving resulted in a fine. Renwick was ordered to pay a total of $1,305 in fines and costs.
Robert Peter Roth, 232 Copperhead Lane, Burgaw, NC, to serve between 90 days and two years less one day in the Warren County Jail, with credit for time served, on a count of DUI: Controlled substance schedule I. Roth was also ordered to serve three years of probation consecutive to his sentence, undergo a drug and alcohol evaluation, attend the alcohol highway safety school and victim impact panel programs, perform 30 hours of community service and serve an 18 month suspension of driving privileges. Roth was ordered to pay a fine for related charges of careless driving and use of multiple-beam road lighting equipment. He was ordered to pay $2,060 in total costs and fines.
Michael J. Schumann, 22 Schumann Rd., was sentenced to one year in the intermediate punishment program; the first 45 days to be served in a halfway house, the following 45 to be served on house arrest and the remainder to be served on probation; with credit for time served, on a count of possession of a controlled substance. Schumann was also ordered to serve a 12 month suspension of driving privileges. On a related charge of DUI: Controlled substance schedule I, Schumann was sentenced to serve between 72 hours and six months in the Warren County Jail. Schumann was also ordered to attend the alcohol highway safety school and victim impact panel programs, undergo a drug and alcohol evaluation, perform 15 hours of community service and serve an additional 12 months suspension of driving privileges. Schumann was ordered to pay a total of $1,800 in fines and costs.
Levi Joseph Shaffer, 4510 Route 27, Pittsfield, to between 48 days and two years less one day in the Warren County Jail, with credit for time served, on a count of criminal trespass. Shaffer was also ordered to a subsequent one year of probation, submit a DNA sample, undergo a drug and alcohol evaluation and perform 50 hours of community service. On an unrelated charge of criminal conspiracy to commit theft by unlawful taking, Shaffer was sentenced to an additional two years of probation and 50 hours of community service. On a further unrelated charge of criminal trespass, Shaffer was sentenced to an additional two years of probation and 50 hours of community service. Shaffer was ordered to pay a total of $4,193.50 in fines, costs and restitution. He is to have no contact with his victims.
Jeremiah A. Smith, 1 West Third Ave., to between one and 22 months incarceration in the Warren County Jail, with credit for time served, on a count of simple assault. Smith was also ordered to undergo a drug and alcohol evaluation. On a count of purchase, consumption, transportation of alcohol by minors, Smith was sentenced to an additional one to two months incarceration in the Warren County Jail to run consecutively and to serve a 90 day suspension of driving privileges. Smith was ordered to pay $1,150 in total fines and costs.
Josh Dean Stallings, 5 Whitney St., to six months of probation for a count of DUI: General impairment - incapable of safe driving. He was also ordered to attend the alcohol highway safety school and victim impact panel programs and perform 15 hours of community service. On a related charge of careless driving, Stallings was ordered to pay a fine. Stallings was ordered to pay $755 in total fines and costs.
Daniel L. Todd, 332 Prospect St., to 5 years in the intermediate punishment program, the first 30 days to be served in the Warren County Jail and the following 60 days on house arrest, with the remainder of the sentence to be served on probation, for a count of DUI: Highest rate of alcohol (BAC .16+). Todd was also ordered to undergo drug and alcohol treatment, undergo mental health treatment, attend the alcohol highway safety school and victim impact panel programs, serve an 18 month suspension of driving privileges and perform 30 hours of community service. For a related count of careless driving, Todd was ordered to pay a fine. Hewas ordered to pay $2,305 in total fines and costs.
