Judge Skerda hands down 23 sentences

Twenty-three defendants were sentenced Friday in Warren County Court with Judge Maureen Skerda presiding.

Among those sentenced were four defendants arrested in February's county-wide drug sweep:

John Anderson, 6 Schantz St., was sentenced to 10 to 48 months, less one day, in a state correctional facility for possession with intent to deliver. The sentence is to run consecutively to a county sentence he is currently serving. Anderson was also sentenced to a one-year suspension of his driving privileges, ordered to participate in drug and alcohol programs while incarcerated and to submit a DNA sample. He was ordered to pay a total of $1,210 in costs, fines and restitution.

Mark E. Hamilton, 63 Houghton Dr., Sheffield, was sentenced for possession with intent to deliver. Hamilton was sentenced to 5 years in the Intermediate Punishment Program, the first six months of which will be served through incarceration in the Warren County Jail, the following three months to be served on house arrest and the remainder to be served through program supervision. Hamilton was also sentenced to a one-year suspension of his driving privileges to run concurrent to a suspension he is already serving. Hamilton was sentenced to an additional year of probation for an unrelated count of possession of drug paraphernalia. He was ordered to pay a total of $1,790 in fines, costs and restitution for all charges.

Ryan Thomas Hannon, 606 Conewango Ave., was sentenced to serve 15 to 36 months in a state correctional facility for possession with intent to deliver. He was also sentenced to a two-year suspension of his driving privileges, ordered to participate in drug and alcohol programs while incarcerated and ordered to submit a DNA sample. On an unrelated charge of resisting arrest or other law enforcement, Hannon was sentenced to two years additional probation, to run consecutively to his incarceration. He was ordered to pay a total of $2,850 in fines, costs and restitution for all charges.

Cody Charles Jackman, 116 N. Irvine St., was sentenced to four days to one year in the Warren County Jail for possession of a controlled substance; credit was given for time served. He was also sentenced to a six-month suspension of his driving privileges, 50 hours of community service and ordered to undergo a drug and alcohol evaluation. Jackman was ordered to pay $800 in fines and costs. Restitution has already been paid.

The following were also sentenced:

James H. Akers, 12 Madison Ave.,to three days to two years, less one day, in the Warren County Jail for indecent exposure, credit was given for time served. He was also sentenced to one year of probation, 50 hours of community service, ordered to participate in a 12-step substance abuse program, ordered to participate in the sexual offenders program and is to have no contact with his victim. He was ordered to pay $1,100 in fines and costs.

Maranda Lynn Anthony, 20775 Lindsey Hollow Rd., Corry, was sentenced to three years probation for receiving stolen property. She was ordered to participate in a 12-step substance abuse program, continue a methadone program, undergo drug and alcohol counseling, obtain her GED and to have no contact with her victim. She was ordered to pay $1,950 in costs, fines and restitution.

Justin Allen Brumbaugh, 1169 Wilson Ave., Kittaning, Pa., to 12 to 36 months in a state correctional facility for receiving stolen property. It will run consecutively to a sentence he is currently serving in a county facility. Skerda commuted his current sentence to a state facility. He was also ordered to provide a DNA sample and to have no contact with his victim. He was ordered to pay $2,150 in fines, costs and restitution.

Howard W. Clark, Warren County Jail, was sentenced to five to 90 days in the county jail for harassment. The sentence will be served consecutively to a sentence he is currently serving; credit was given for time served. He was also fined $300 for a count of public drunkenness stemming from the same incident. In an unrelated incident, Clark was sentenced to serve between 45 and 90 days in the county jail for a charge of disorderly conduct.; that sentence will run concurrently. He was also ordered to undergo an anger management evaluation. He was ordered to pay $1,266.80 in total fines, costs and restitution.

Michael Connolly, 16 Walnut St., was sentenced to 30 days to two years, less one day, in the Warren County Jail for criminal trespass. He was also sentenced to one year of probation and 60 hour of community service, was ordered to undergo drug and alcohol treatment and is to have no contact with his victim. He was sentenced to an additional one year of probation, to be served consecutively, for a related charge of harassment. Connolly was ordered to pay a total of $1,050 in fines and costs.

John Kyle Phinney, Warren County Jail, was sentenced to four to 30 months in a state correctional facility for theft by unlawful taking. The sentence is to be served consecutively to a sentence he is currently serving. He is to have no contact with his victim. Phinney was ordered to pay $1,204.99 in fines, costs and restitution.

Brenda Lee Ellis, 444 Conewango Ave., was sentenced to one year of probation for false identification to law enforcement. She was sentenced to 60 to 90 days in the Warren County Jail for a related charge of driving while operating privilege is suspended or revoked. She was also sentenced to a one-year suspension of her driving privileges. Ellis was ordered to pay $1,350 in total fines, costs and restitution.

Tobin Joseph Farr, 410 1/2 Hazel St., was sentenced to one year of probation for theft by unlawful taking. He was also sentenced to 60 hours of community service and is to have no contact with his victim. Farr was ordered to pay $950 in fines, costs and restitution.

Christopher Joseph Frederick, 1925 1/2 Pennsylvania Ave., E. Apt. D, was sentenced to 58 days to two years, less one day, in the Warren County Jail for retail theft; credit was given for time served. He was also sentenced to 80 hours of community service and ordered not to trespass on the property of the store where the incident took place. Frederick was ordered to pay $752 in fines, costs and restitution.

James Leroy Gall, 2067 Lake Rd., Cochranton, was sentenced to five years in the Intermediate Punishment Program, the first 30 days to be served in the Warren County Jail, followed by 60 days electronic monitoring, with the remaining period to be served under program supervision for DUI: general impairment, incapable of safe driving. He was also sentenced to 18-months suspension of his driving privileges, 30 hours of community service, ordered to complete the alcohol highway safety school program, ordered to attend the victim impact panel and ordered to attend the DUI instructional program. Gall was also ordered to pay $55 in fines and surcharges for a related count of driving on right side of roadway. Gall was ordered to pay a total of $2,205 in fines, costs and surcharges.

Jessie Joe Greenhalgh, 13 1/2 Elm St., was sentenced to three months to one year in the Warren County Jail for receiving stolen property. He was also sentenced to perform 50 hours of community service. For a related count of accident involving damage to unattended vehicle/property he was sentenced to serve an additional 45 to 90 days in the county jail, to be served consecutively. Greenhalgh was ordered to pay $ 1,183.70 in total fines, costs and restitution.

John Carlton Irvine, 8 Swiss St., was sentenced to two years probation for simple assault. He was also sentenced to 80 hours of community service, ordered to complete healthy relationship and anger management evaluations and was ordered to continue his current drug and alcohol treatments and attend at least three Alcoholics Anonymous meetings each week. Skerda said she considered Irvine's completion of in-patient substance abuse rehabilitation in her sentencing. Irvine was ordered to pay $800 in fines and costs.

Charles Edward Jackson, Lot 1, W. Washington St., Corry, was sentenced to four to 24 months in a state correctional facility for receiving stolen property. His sentence is to run concurrent to a state facility sentence he is currently serving. Skerda noted she considered cooperation Jackson is providing to prosecutors of the case of a co-defendant in the same incident in her sentence. Jackson was ordered to pay $6,149 in fines, costs and restitution.

Kenneth Gregory Kiser, 115 Stoney Mountain Ln., was sentenced to 72 hours to six months in the Warren County Jail for DUI: general impairment-incapable of safe driving-refusal of testing. He was also sentenced to a 12-month suspension of his driving privileges, 30 hours of community service, ordered to complete the alcohol highway safety school program, ordered to attend the victim impact panel and must follow through with drug and alcohol treatment. For a related count of disorderly conduct, he was sentenced to serve one year of probation consecutively to any probation due to his DUI. He was also ordered to pay fines for related charges of driving on right side of roadway and careless driving. Kiser was ordered to pay $1,760 in total fines, costs and restitution.

Marc T. Lobdell, 140 Keenan St., Clarendon, was sentenced to six months probation for DUI: general impairment-incapable of safe driving. He was also ordered to perform 15 hours of community service, participate in a 12-step substance abuse program, undergo drug and alcohol counseling, complete the alcohol highway safety school program and attend the victim impact panel. For a related charge of simple assault, he was sentenced to two years of probation to be served consecutively. For a related charge of resisting arrest or other law enforcement, he was sentenced to one year of probation to be served consecutively. He was fined for a related charge of public drunkenness. Lobdell was ordered to pay $2,000 in total fines, costs and surcharges.

Michelle L. Minnis, 67 Ford St., Youngsville, was sentenced to two-years probation for resisting arrest or other law enforcement. She was also ordered to participate in a mental health regimen as dictated by a professional and to complete 30 hours of community service unless it conflicts with mental health professional recommendations. Minnis was ordered to pay $600 in fines and costs.

Jessica Elizabeth Neizmik, 108 Wilderness Park, Clarendon, was sentenced to nine to 36 months in a state correctional facility for possession with intent to deliver. The sentence is to be served consecutively to a sentence she is currently serving. She was also sentenced to a six-month suspension of her driving privileges, to utilize any drug and alcohol treatment programs available at state facilities and to submit a DNA sample. Neizmik was ordered to pay $1,600 in fines and costs.

Craig Robert Nelson, 6 Vine St., North Warren, was sentenced to 90 days probation for disorderly conduct. He was also ordered to continue treatment for post traumatic stress disorder, to have no contact with his victim and not to trespass at the school where the incident occurred unless he is present for a valid function involving his child. Nelson was ordered to pay $400 in fines and costs.

Alicia Louis Pape, 26 Keystone Ave., Sheffield, was sentenced to six months to two years in the Warren County Jail, less one day, for criminal conspiracy (manufacture/delivery/possession with intent to deliver); credit was given for time served. For a related charge of possession with intent to deliver, she was sentenced to five years in the Intermediate Punishment Program, the first 90 days served under house arrest, with remaining time served under program supervision. The sentence is to run consecutively to her criminal conspiracy sentence. She was also sentenced to a six-month suspension of her driving privileges, to perform 250 hours of community service and undergo a drug and alcohol evaluation. For a related charge criminal use of a communications facility, she was sentenced to two years of probation to be served consecutively to her other sentences. For an unrelated charge of retail theft, she was ordered to pay a fine and not to trespass at the location where the incident occurred. Pape was ordered to pay $4,033.82 in total fines, costs and restitution.

Daniel R. Smith, 4694 Stillwater Rd., Sugar Grove, was sentenced to one year of probation for unsworn falsification to authorities. He was also ordered to perform 80 hours of community service. Smith was ordered to pay $1,200 in fines and costs.

Gregory Scott Wees, Warren County Jail, was sentenced to between 11 and 36 month in a state correctional facility for criminal trespass, credit was given for time served of 163 days. He was also ordered to submit a DNA sample. Wees was ordered to pay $1,500 in fines and costs.

Skerda issued a bench warrant for Christian S. Iverson for failure to appear in sentencing court on a count of possession of drug paraphernalia.

Scott William Wagner, 1121 Spring St., was not sentenced Friday as scheduled. Skerda said she found the agreement his plea of guilty was based on invalid due to the circumstances of his charges. Wagner was offered a new, valid agreement to plead guilty to a more serious charge. He chose to enter a plea of not guilty in open court. Skerda ordered the case moved to the county trial list.
