Sentences handed down in county court

A Clarendon man would have been permitted to leave the Warren County Courthouse with a probationary sentence had he not shown up to court drunk.

As Alexander D. Layden, 42, of 10226 Route 6, Clarendon, approached the bench to receive his sentence for a DUI charge and two summary offenses, he stumbled.

Presiding Judge Maureen Skerda handed Layden a sentence of 6 months probation, 15 hours community service and several fines and fees and for the DUI charge. He was also remanded to fines and fees for the summary offenses. However, a probation official later found Layden to be under the influence of alcohol.

When the defendant was called back to the courtroom, District Attorney Ross McKeirnan indicated that Layden had a blood alcohol content of .39.

Although Skerda noted Layden's disruptive behavior where he answered "Yes, your Honor," to everything she said, the judge was concerned with the defendant' s ability to understand his sentence.

"The sentence is vacated at this point," Skerda said.

Layden was placed in Warren County Jail and will be re-sentenced at a later time when he is sober.

Also sentenced Friday were:

Mark A. Steffan, 31, 212 East St. Apt. 1, to 15 months to five years in a state correctional institution, $2,025 in fines and fees, $9,825.63 in restitution, 18 months driver's license suspension, attend and pay for the Highway Safety School, 30 hours of community service, pay the cost of prosecution and undergo drug and alcohol treatment for DUI.

Valerie S. Bailey, 34, 1008 Chapman Dam Rd., Clarendon, to 60 days to two years less one day in county jail, $1,600 in fines and fees, pay the cost of prosecution and 100 hours of community service for theft by unlawful taking or disposition.

Eugene L. Bevil, 35, 1220 Howard Rd., Russell, to two years probation, $1,150 in fines and fees, $146.60 in restitution, 60 hours community service, attend anger management classes and pay the cost of prosecution for terroristic threats.

Matthew R. Bryant, 20, 409 Laurel St., to a $200 fine, $500 in restitution, pay the cost of prosecution and attend anger management classes for harassment.

Jessica A. Devlieger, 22, 12 W. Third Ave. Apt. 3, to one year probation, a $1,000 fine, 50 hours community service and pay the cost of prosecution for sell/furnish liquor to minors.

Matthew E. Edmiston, 46, 210 Six Mile Rd., Tiona, to 30 days in county jail, 60 days house arrest, 57 months probation, $2,100 in fines and fees, attend and pay for the Highway Safety School and Victim Impact Panel, 30 hours of community service, 18 months driver's license suspension and pay the cost of prosecution for DUI; and to $55 in fines and fees for maximum speed limits.

Willard Rosco Fehlman, 35, 100 Valley Circle Dr., Sugar Grove, to nine months to two years less one day in county jail, $880 in fines and fees, one year driver's license suspension and pay the cost of prosecution for fleeing or attempting to elude a police officer; to 60 to 90 days in count jail, one year driver's license suspension and $530 in fines and fees for driving while under suspension; and to six months driver's license suspension and $230 in fines and fees for reckless driving.

Ronald L. Gray, 41, 82 Griff Hill Rd., Clarendon, to 90 days to six months in county jail, $1,600 in fines and fees, one year driver's license suspension, attend and pay for the Highway Safety School and Victim Impact Panel, 15 hours community service, undergo drug and alcohol counseling and pay the cost of prosecution for DUI; and to six months driver's license suspension, $600 in fines and fees and $176 in restitution for possession of small amount of marijuana.

Brent A. Haehn, 32, 717 Emerson Hill Rd., Grand Valley, to 30 days to 2 years less one day in county jail, $600 in fines and fees, 100 hours of community service and pay the cost of prosecution for sale or transfer of firearms.

Daniel R. Johnson, 28, 1108 Madison Ave., to 30 days to two years less one day in county jail, $1,775 in fines and fees, three years probation, six months driver's license suspension, undergo a drug and alcohol evaluation and pay the cost of prosecution for criminal conspiracy for possession with intent to deliver.

Thomas Lee Keeney, 26, 112 Prospect St., to four days to two years less one day in county jail, $600 in fines and fees, attend anger management classes, 60 hours community service and pay the cost of prosecution for simple assault.

Matthew J. Leonard, 20, 1017 Conewango Ave., to 30 days to two years less one day in county jail, $650 in fines and fees and pay the cost of prosecution for theft by unlawful taking or disposition; to one year probation, $750 in fines and fees, six months driver's license suspension and pay the cost of prosecution for possession of a small amount of marijuana; to 48 hours to six months in county jail, one year driver's license suspension, $650 in fines and fees, attend and pay for the Highway Safety School and Victim Impact Panel, 15 hours community service and undergo drug and alcohol treatment for DUI; and to$55 in fines and fees for general lighting requirements.

Melissa M. Proper, 27, 31046 Route 6, Pittsfield, to 72 hours to six months in county jail, $1,675 in fines and fees, one year driver's license suspension, attend and pay for the Highway Safety School and Victim Impact Panel, 15 community service, attend DUI prevention class and pay the cost of prosecution for DUI; and to a $400 fine, one year probation, 60 hours community service and attend parenting class for recklessly endangering another person.

Ryan Lee Southwell, 33, McEllhattan, Pa., to 90 day in county transferred to Clinton County, 57 months probation, 18 months driver's license suspension, $2,150 in fines and fees, 30 hours community service, attend and pay for the Highway Safety School and Victim Impact Panel and pay the cost of prosecution for DUI.

Daniel Lewis Todd, 31, 124 Oak St., to 72 hours to six months in county jail, $1,675 in fines and fees, 18 months driver's license suspension, 15 hours community service, attend and pay for the Highway Safety School and Victim Impact Panel and pay the cost of prosecution for DUI.

Julia M. Verdot, 63, 209 Market St. Apt. 401, to five years probation, 100 hours community service, a $250 fine and pay the cost of prosecution for possession with intent to deliver.

Rodney W. Wilkins, 28, 16 N. Main St., to 30 days to six months in county jail, $1,100 in fines and fees, one year driver's license suspension, attend and pay for the Highway Safety School and Victim Impact Panel, 30 community service and pay the cost of prosecution for DUI; to $530 in fines and fees for abandonment of vehicle on highway; to $230 in fines and fees for false reports; and to $55 in fines and fees for restriction on alcoholic beverages.

Benjamin R. Wilson, 28, 36 Crestview Blvd., to 30 days in county jail, 60 days house arrest, 57 months probation, 18 months driver's license suspension, $2,150 in fines and fees, attend and pay Highway Safety School and Victim Impact Panel, 30 hours community service and pay the cost of prosecution for DUI; to $55 in fines and fees for driving on roadways laned for traffic; to $55 in fines and fees for turning movement and required signals; to $55 in fines and fees for careless driving; and to $55 in fines and fees for restraint systems.
