Who does and doesn’t need business license

The City of Warren administration has released a list of answers to commonly asked questions regarding the city's recently approved Business License ordinance, which charges businesses operating in the city a yearly fee of $10 to $50.

The business license is required by all businesses operating within the city and application for said license needs to be made before business can commence.

According to the city's administration, exemptions apply to:

Any business activity not within the taxing power of the city under the Constitution of the United States and Laws of the Commonwealth of Pennsylvania.

Employees or agencies of the government of the United States or Pennsylvania.

Any temporary, seasonal or itinerant businesses that is subject to Chapter 13, Part 3 of the Code of the City of Warren relating to peddling, soliciting or transient.

Non-profit corporations or associations solely for religious, education or charitable purpose not conducting any regular or established business competing commercially with any business subject to the fee.

Farmers who offer for sale or sell or peddle from house to house or in markets, farm or garden products raised by farmer from lands occupied and cultivated by him within the Commonwealth.

Garage/yard sales, provided such sales are operated for three days/three times per year.

Applications for the business license will be mailed out to all registered businesses on a annual basis on or before Dec. 31 of the proceeding year. New businesses can apply online or pick up the application at the city tax office after Nov. 30.

The new ordinance goes into effect on Jan. 1, 2010. Business owners will have until May 15 to acquire a license without penalty.

The license must be posted on the premises doing business, carried on the person when the business is not physically located within the city and/or posted in a conspicuous place when business is conducted from a vehicle.

A pro-rata fee will be available for new businesses operating after Jan. 1 in any given year.

A business license cannot be transferred to another person if the business is sold or closed.

The fees for the license is as follows: $50 for a business with gross receipts over $100,000 per year; $25 for gross receipts between $5,000 and $100,000; $10 for gross receipts of up to $5,000 or a new business.

The city may request a copy of IRS Form Schedule C or Schedule E or such other form or schedule that is acceptable to the IRS for federal income tax purposes if a businesses declared gross is challenged by the city.

Any business serving food or drink to the public must still have a health license under the business license ordinance.

The city state that businesses licensed under the new ordinance will not be subject to routine inspections. However, if the city receives reports of conditions that may affect the public health, morals or welfare, such an inspection may occur, which could result in the revocation of the license.

thinkaboutit, from what I understand, it doesn't matter if you live in the city, if you come into the city to do business you need a license. I may be mistaken, but that was how it read to me.

The city will do anything to keep businesses out of the city. I have a small businesses with it address as my home and live outside the city, but have thought of moving into the city. I already don’t like many of the ordinances and taxes that the city imposes on it’s residence. This just gives me another reason to stay outside of the city. If by chance I did move to the city to live, I would establish a new address outside of the city for my business in a town that is more business friendly and not use my home address.

And what about people who run two types of home based businesses? Will they need two licenses since they are different types of businesses?

Maybe the money is to staff the phones , Pleasant man....LOL lets just give them more money. Do they ever account for what they spend? Just curious.

I think this ordinance is to be used to fund the Main Street program. We now have a Main Street office and Gro Warren neither of which are getting anything none. Try calling them during regular buisness hours and see if anyone answers. Leave a message and see if anyone returns the call. They never return my calls.

Do you know if Home Based Businesses like Partylite, Mary Kay, Pampered Chef need a license if they hold parties in the City of Warren?

If you go to the city website, yes, doctors and lawyers are included in needing this license. If you also read this ordinance, it does not state that there needs to be a reason for inspections, it just says they(the city) has the right to inspect you. IT also says that they can deny you based on morals and public safety but yet does not define those issues. McDonald's causes obesity and anyone selling a crystal could be considered a witch, whose standards are they going by if they lack definition. It is a very poorly written piece of work.

Are attorneys and doctors independent businesses under this ordinance? If so, that should open a real interesting can of worms.

I bet that should bring about a scurry of activity to come up with an opinion to exempt them.

Every turn is another reason for business to walk away from this ridulous entity referred to as a "city". It's becoming something similar to a boat..****monly referred to as a "very large hole in the water into which one pours much money", however, a boat gives back SOMETHING pleasureable.

hmmm. did they figure out that they have a lot of people angry about this license that was just shoved off on the businesses with no warning or chance for discussion?
