WMo2: The legal axiom established in McCulloch v. Maryland in 1819 -- the power to tax is the power to destroy -- prevents governments within the United States from taxing one another's instruments (property or funds). Plus, just imagine the mess...the county taxing the city, the city taxing the county, the state taxing them both, both of them taxing the state. Pretty soon the taxpayers of any municipality would be paying taxes to an individual taxing entity 3 or 4 times.

Mr. Bortz fails to address one major question - If the PILOT is a reasonable option then why hasn't the hospital and other entities come forward during this entire process and made an offer? Are they restricted from coming forward and seeking a reasonable solution such as recognition that they do perform and underwrite a certain amount of charity but also consume tremendous amounts of public service dollars. For instance maybe an agreement could be worked out that they would pay 35% of the assessed tax bill and the County could sign a 20 year contract in order that the Hospital would gain assurances as to the rate and that the residents of the County wouldn't have the burden of underwriting all public dollar services that the Hospital receives. Everyone who studies this knows that the Hospital severely inflates their charitible giving numbers when they utilize the published dollar rates for services, a rate that virtually no one and certainly no insurance company pays

Brazil: "reasonable," "reasonable solution." That's twice in a single post that you have used words that are not part of the Warren County vocabulary. Are you from some far-off land, or perhaps a time traveler from the future?

warrenmom, these are NON-GOVERNMENTAL entities that are tax-exempt. They should not be. Nobody should be tax-exempt, but we have to start somewhere. All churches, hospitals, etc., should pay municipal and county property taxes (not school tax) because they directly benefit from the services. County should pursue the matter. Right is right.
