Warren man jailed in alleged domestic incident

A Warren man is in jail after police allege that he broke a woman’s arm during a domestic altercation.

According to the affidavit of probable cause, county control dispatched officers to a physical domestic incident on Tuesday, Aug. 21 at at 413 Fourth Avenue around 10:54 p.m.

There, they met the victim who told them that she and John Lusk Jr., 61, had been drinking together at Fat Daddy’s but that they’d gotten into an argument when Lusk drove her home. The argument continued when they reached the victim’s residence, she told police, at which point Lusk shoved her to the ground, causing redness and swelling to her back and right arm.

The victim was transported to Warren General Hospital, where it was determined that her arm was broken.

Police made contact with Lusk at his residence, the affidavit states, where he was taken into custody.

Lusk was “highly intoxicated at the time,” according to the affidavit.

Police noticed that the same black sedan he was reported to have left the scene of the domestic incident in, and which officers had seen being driven nearby while they were interviewing the victim, was parked in Lusk’s driveway.

Lusk’s keys were in his pocket at the time of his arrest, police said.

Lusk refused to submit to chemical testing, or to proceed with an interview without an attorney present, police said.

He was arraigned before District Justice Daniel Miller Wednesday morning on one felony count of aggravated assault and one misdemeanor count of DUI – general impairment and remanded to the Warren County Jail in lieu of $25,000 bail. A preliminary hearing is scheduled for Wednesday, Aug. 29 at 2 p.m.
