Fifteen defendants sentenced on Friday

The following defendants were sentenced by Judge Gregory Hammond on Friday.

All periods of incarceration are to be served in the Warren County Jail unless otherwise specified.

¯ Devon J. Baptiste, Clarendon, to a six month intermediate punishment sentence on a count of DUI: Highest rate of alcohol – first offense. That includes 72 hours of incarceration with the balance on probation, a $500 fine, $750 in fees, to complete the alcohol highway safety school and victim impact panel programs, participate in drug and alcohol treatment and complete 15 hours of community service. His driver’s license was suspended for 12 months and he is work release and early reentry eligible. He was fined a total of $70 each on counts of careless driving, driving on roadways laned for traffic and registration card signed/exhibited on demand.

¯ Dean A. Carlson, Clarendon, to a six month intermediate punishment sentence on a count of DUI: Highest rate of alcohol – first offense. That includes 48 hours incarceration with the balance on probation, a $500 fine, $500 in fees, completion of the alcohol highway safety school and victim impact panel programs and 15 hours of community service. His license was suspended for 12 months and he is work release and early reentry eligible. Hammond ordered that he not be released until a drug and alcohol evaluation was completed and that treatment be part of his sentence. He was fined a total of $70 for driving on right side of roadway. At a second docket, he was sentenced to a consecutive six month intermediate punishment on a count of DUI: General impairment/incapable of safe driving · second offense. That includes five days incarceration with the balance on probation, a $300 fine, $400 in fees, 30 hours of community service and a 12 month license suspension. He was fined $300 on a count of disorderly conduct and a total of $70 on a count of careless driving.

¯ Courtney A. Chamberlain, Warren, to a five year intermediate punishment on a count of possession with intent to deliver. The first seven months are to be served as restrictive with 138 days as incarceration to be followed by 30 days of inpatient drug and alcohol treatment and then house arrest. The duration of the five years will be served on probation. She was fined $1,000, $725 in fees and $140 in restitution to the Warren County Drug Task Force. She was ordered to submit a DNA sample and 60 hours of community service. Her license was suspended for six months and she was given credit for time served. On a count of conspiracy (knowingly possess ephedrine), she was sentenced to a consecutive six months probation, fined $500, ordered to pay $100 in fees and to complete 10 hours of community service. Her license was suspended for an additional year. On two additional counts of conspiracy (knowingly possess ephedrine), Chamberlain was sentenced to six months consecutive probation, a $500 in fines and $100 in fees, a two year license suspension and 10 hours of community service.

¯ Floyd M. Cornell, Corry, to a six month intermediate punishment on a count of DUI: Highest rate of alcohol – second offense. The first 30 days will be served as incarceration and the duration on probation, fined $750, ordered to pay $100 in fees, complete the alcohol highway safety school and victim impact panel programs, undergo a drug and alcohol evaluation and follow through with treatment and complete 30 hours of community service. His license was suspended for 12 months and he is work release and early reentry eligible. He was fined $300 on a count of snowmobile insurance required and 25 each on counts of stop signs and yield signs, careless driving and unlawful operation snow/ATV in a careless way. On a count of driving while operating privileges are suspended or revoked, he was sentenced to 90 days incarceration, a $500 fine and $375 in fees and an additional year license suspension.

¯ Gordon R. Godden, Warren, to one year probation, a $300 fine, $375 in fees and 20 hours of community service on a count of unsworn falsification to authorities.

¯ Douglas Harkins, Sugar Grove, to 15 to 30 months incarceration in a state correctional facility on a count of possession with intent to deliver. He was fined $1,000, ordered to pay $725 in fees and $70 in restitution to the Warren County Drug Task Force. His license was suspended for one year and he was ordered to submit a DNA sample and undergo a drug and alcohol evaluation and follow treatment recommended. He is not boot camp or recidivism risk reduction incentive eligible. On a count of fleeing or attempting to elude police, Harkins was sentenced to a consecutive six to 12 months in state prison, $500 fine and one year license suspension.

¯ Rodney Hillyard, Jamestown, NY, to a six month intermediate punishment sentence on a count of DUI: General impairment/incapable of safe driving – first offense. The first 48 hours is to be incarceration with the duration served on probation. He was fined $500, ordered to pay $500 in fees, to complete the alcohol highway safety school and victim impact panel programs and complete 15 hours of community service. His license was suspended for 12 months and he is work release eligible.

¯ Troy L. Lindell, Clarendon, to a six month intermediate punishment sentence on a count of DUI: High rate of alcohol – first offense. The first 30 days are to be served as incarceration with the balance on probation. Hammond said that the sentence was aggravated because Lindell had been revoked in the ARD program. He was fined $500, ordered to pay $425 in fees, to complete the alcohol highway safety school and victim impact panel programs, complete 15 hours of community service and comply with drug and alcohol treatment recommendations. His license was suspended for 12 months. He is work release and early reentry eligible. On a count of careless driving, he was fined a total of $70.

¯ Colby E. Lyle, Warren, to six months to two years less one day incarceration on a count of simple assault. He was fined $500, ordered to pay $375 in fees, ordered to undergo a drug and alcohol evaluation and follow any treatment recommendations, to complete healthy relationships program and to complete 30 hours of community service. He was given credit for time served and is work release and early reentry eligible. On a count of public drunkenness, he was fined $300.

¯ Bryan D. Nipp, Warren, to two years probation, a $500 fine and $375 in fees, to have no contact or communication with the victim and not trespass on their property, to complete 30 hours of community service and undergo a sexual offender assessment and any recommended treatment on a count of indecent exposure.

¯ Tara A. Nulph-Constable, Warren, to eight months to 24 months in state prison on a count of possession with intent to deliver. She was fined $1,000, ordered to pay $600 in fees and $200 in restitution to the Warren County Drug Task Force, to undergo a drug and alcohol evaluation and follow through with treatment and to submit a DNA sample. She was given credit for time served and her license was suspended for one year. She is boot camp and recidivism risk reduction incentive eligible. On a count of conspiracy (precursor chemicals) she was sentenced to a consecutive four to 12 months incarcerated, fined $500, ordered to pay $100 in fees and an addition year license suspension. At a second docket, she was sentenced to one year consecutive state probation, a $300 fine and to not trespass on Walmart property on a count of conspiracy (retail theft).

¯ Jesse J. Reed, Corry, to six months to one year in state prison on a count of statement under penalty. He was fined $300 and ordered to pay $250 in fines and fees.

¯ Zachary Rounds, Tidioute, to 12 to 36 months in state prison a count of criminal attempt · possession with intent to deliver. He was fined $1,000, ordered to pay $725 in fees, have no contact with the victim, submit a DNA sample and undergo a drug and alcohol assessment and follow treatment recommendations. His license was suspended for 12 months. He was given credit for time served and is boot camp and recidivism risk reduction incentive eligible. At a second docket, he was sentenced to a consecutive six to 18 months in state prison, fined $1,000, ordered to pay $225 in fees and $25 in restitution to the Warren County Drug Task Force and an additional two year license suspension on a count of possession with intent to deliver. At a third docket, he was sentenced to 72 hours to six months in prison consecutively on a count of DUI: Controlled substances · Schedule II or III · first offense. He was fined $1,000, ordered to pay $300 in fees, to complete the alcohol highway safety school and victim impact panel programs and his license was suspended for an additional year. On a count of possession – small amount of marijuana, he was fined $300, ordered to pay $100 in fees and his license was suspended for an additional six months. He was fined a total of $70 each on charges of driving unregistered vehicle, registration card to be signed/exhibited on demand and turning movements and required signals.

¯ Jason M. Tice, Ludlow, to one year probation, $169.30 in restitution, not to trespass on Walmart property and 30 hours of community service on a count of theft by deception.

¯ Patty A. Tucker, Grand Valley, to 7 days to two years less one day incarceration on a count of interference with the custody of a committed person. She was fined $500, ordered to pay $375 in fees, to complete 30 hours of community service and given credit for seven days time served making her eligible for immediate parole. On counts of simple assault and obstructing the administration of law or other governmental function, she was sentenced to consecutive one year probation terms, fined $300 and ordered to complete an additional 30 hours of community service. On a count of harassment, she was fined $100. Hammond said that current provisions through Children and Youth Services would also be a part of her order.
