Judge sentences 12, two to state prison

During sentence court proceedings Friday, Judge Gregory Hammond sentenced a total of 12 defendants, with two of them to served terms in state prison.

Sentenced to prison were:

Michael T. Roberts, 47, Warren, to 24 to 72 months with credit for time served, restitution in the amount of $25,276.62, a $1,000 fine, court costs, $500 in fees, a drug and alcohol evaluation, a DNA test, and no contact with the victim for felony criminal mischief.

Ruben Montilla, 31, Jamestown, N.Y., to 27 to 81 months with credit for time served, a $1,000 fine, court costs, $725 in fees, a drug and alcohol evaluation, a DNA test, 24-month drivers license suspension, boot camp and recidivism risk reduction initiative (RRRI) eligible, for possession with intent to deliver; and another nine to 27 months to be served consecutively, another $1,000 fine, also boot camp and RRRI eligible subject to Department of Corrections approval, for criminal use of a communication facility.

Also sentenced were:

John R. Blauser, 58, Port Allegany, to six months to two years minus one day in jail with credit for time served – early re-entry and work release eligible, a $500 fine, court costs, $375in fees, a drug and alcohol evaluation, no contact with the victim, and a mental health evaluation, for terroristic threats.

Lonnie G. Dombrowski, 54, Clarendon, to 48 hours to six months in jail – early re-entry and work release eligible, a $500 fine, court costs, $650 in fees, attend and complete the Victim Impact Panel and Alcohol Highway Safety Program, a 12-month driver license suspension, and 15 hours of community service, for DUI: high rate of alcohol – first offense; one year consecutive probation, a $300 fine, an additional six-month license suspension, for accident with damage to attended vehicle or property; a $25 fine and $45 surcharge for careless driving; and a $25 fine and $45 surcharge for failure to notify police of accident.

Benjamin J. Ernewein, 32, Sugar Grove, to 10 months to two years minus one day in jail – early re-entry and work release eligible, one year of consecutive probation, a $1,000 fine, court costs, $725 in fees, a drug and alcohol evaluation, one-year drivers license suspension, and a DNA test, for possession with intent to deliver.

Rufus H. Frederick, 43, Warren, to a sentence of five years including 30 days in jail, nine months of house arrest with electronic monitoring – work release eligible, and the remainder as probation, a $1,500 fine, court costs, $250 in fees, 18-month drivers license suspension, and 30 hours of community service, for DUI: highest rate – second offense; 90 days in jail with credit for time served – early re-entry and work release eligible, a $1,000 fine, $375 in fees, and an additional 12-months drivers license suspension, for driving while license suspended; and three years consecutive probation, a $1,000 fine, a $250 fee, and 50 hours of community service, for receiving stolen property.

Adrianna M. Mealy, 25, Warren, to two years of probation to be served consecutive to an existing sentence, $12,350 in restitution, a $500 fine, court costs, a $250 fee, a drug and alcohol evaluation, and 40 hours of community service, for theft by deception; two years of consecutive probation, a $500 fine, and 40 hours of community service, for forgery; and two years of consecutive probation, a $500 fine, and 40 hours of community service, for another count of forgery

Laura A. Reed, 32, Warren, to a sentence of five years including 48 hours in jail and the remainder as probation, a $1,000 fine, court costs, $425 in fees, attend and complete the Victim Impact Panel and Alcohol Highway Safety Program, a 12-month drivers license suspension, and 100 hours of community service, for DUI: high rate of alcohol – first offense; a $25 fine and $45 surcharge, for notice of change of name or address; and a $25 fine and $45 surcharge, for careless driving.

Lugene H. Sturdevant, 27, Youngsville, to nine days to two years minus one day in jail with credit for time served, $200 in restitution, a $500 fine, court costs, $625 in fees, a mental health evaluation, no contact with the victim, a DNA test, and 30 hours of community service, for criminal trespass; and two years of consecutive probation, a $500 fine, and 30 hours of community service, for theft by unlawful taking.

Dustin J. Sullivan, 28, Warren, to 30 days to one year in jail with credit for time served – early re-entry and work release eligible, a $500 fine, court costs, $375 in fees, no contact with the victim, and 30 hours of community service, for recklessly endangering another person; 30 days to one year minus one day in jail to be served consecutively, a $500 fine, and 30 hours of community service, for simple assault; one year of consecutive probation, a $300 fine, and 20 hours of community service, for defiant trespass; and one year of consecutive probation, a $300 fine, and 20 hours of community service, for criminal mischief.

Todd A. Swarm, 20, Columbus, to 90 days to two years minus one day in jail with credit for time service – early re-entry and work release eligible, $240.67 in restitution, $500 fine, court costs, $625 in fees, a DNA test, and 30 hours of community service, for criminal trespass; and two years consecutive probation, a $500 fine, and 30 hours of community service, for theft by unlawful taking.

Joshua R. Tkach, 31, Sheffield, to six months of probation, a $500 fine, court costs, $550 in fees, attend and complete the Victim Impact Panel and Alcohol Highway Safety Program, at 15 hours of community service, for DUI: general impairment – first offense; and a $25 fine and a $45 surcharge, for general lighting requirements.

A bench warrant was issued for the arrest of Clifford T. Bergeron for failure to appear.
